"The only thing I would recommend, is Daniel should have kept a more cooler head." --That's bull! Anyone who doesn't get angry when his rights are being violated isn't an American. Period. All this "we should all kiss the police's butt no matter what they do because we love our mommy gov't" is bull. The only thing he did wrong was give them his ID and consent to them running the serial number on his gun. They had no right to it.

That's why it's hilarious that people are more scared of everyday citizens having guns than cops. Cops have no clue what they're doing with guns half the time. Citizens who carry are usually better informed and have better aim...and way more common sense than to point an assault rifle at passing traffic.

"Just got word today, the prosecutor dropped all charges, and, returned the property they stole from him." --Good news. But I assume they still got away with the assault, battery and unlawful imprisonment?

Cops can't just "check out" gun calls. The Constitution and Supreme Court both say that you can ONLY detain someone if you have a reasonable, articulable suspicion of a crime. Owning and carrying a gun is not that. He was illegally detained and the cops violated his rights. They can't "check out" gun calls this way anymore than they could search your car "just to make sure" that there was nothing illegal. That's why we're "innocent until proven guilty."FreeStateProject*org

The guy had a CCW permit what exactly is the problem? The cops should have sent him on his way as soon as they looked at his permit. Open is carry is legal in Ohio anyway.

These officers were WAYYYY outside the law. They're criminals. They have no right to detain someone to "figure out what was going on" without reasonable, articulable suspicion that a crime had been committed. Open Carrying is NOT enough. That's why the charges were dropped.
OnGuard4Liberty (October 5, 2007 at 6:26 pm)
All this shows is that more citizens need to start carrying openly. It gives the cops an opportunity to learn the law and it shows that law abiding people carry. The only reason this happened was because more people don't open carry. OpenCarry*com ... go to the forum on your state and start exercising your rights!

These cops need some major remedial training!! Both on firearms law and the Constitution. I hope this guy sues the department...b/c he'd definitely win. This humiliating exercise those cops had him do is inexucusable. His rights were violated and justice needs to be done here.Welcome to the police state!!

They charged him with failure to notify officers of conceal and carry license, which he CLEARY notifies them in this tape not minutes after they pick him up off the ground like a criminal. Evidence that the Oregon City Police tried to supress from evidence. Lucky they dismissed the criminal charges agains Mr. Sayers, they would have even a bigger lawsiut against them right now.
